1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the websites, platforms, APIs, integrations, AI solutions, and related services (collectively, the "Services") provided by Yasmany González ("we," "us," or "our"), operating through yasmany.es and affiliated platforms including those developed under Webtronic Labs and Gloria AI.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Description of Services

We provide:

  • AI solutions and consulting: Custom AI development, strategy, and implementation services.
  • Platforms: Web-based AI platforms, dashboards, and tools for interacting with AI systems.
  • APIs and integrations: Programmatic access to AI models, data processing pipelines, automation workflows, and third-party service connectors.
  • Middleware services: Intermediary connections between your systems and third-party AI providers, data sources, and external services.

3. Accounts and Access

  • You may need to create an account or obtain API credentials to access certain Services.
  • You are responsible for maintaining the confidentiality of your credentials (passwords, API keys, tokens).
  • You are responsible for all activities that occur under your account or credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to use the Services to:

  • Generate, process, or distribute harmful, abusive, defamatory, or illegal content.

  • Circumvent rate limits, authentication mechanisms, or security measures.
  • Use the Services to build competitive products by systematically extracting data or functionality.
  • Transmit malware, viruses, or other harmful code.
  • Overload or interfere with the integrity or performance of the Services.
  • Misrepresent AI-generated outputs as human-created where disclosure is required by law.

5. Customer Data and Content

5.1 Your Data

You retain ownership of all data, content, and materials you submit to the Services ("Customer Data"). You grant us a limited, non-exclusive license to process Customer Data solely to provide and improve the Services.

5.2 AI-Generated Outputs

Outputs generated by our AI Services based on your inputs are provided "as is." You are responsible for reviewing, validating, and determining the suitability of any AI-generated output before use. We do not guarantee the accuracy, completeness, or fitness for purpose of AI outputs.

5.3 Data Processing

When our Services act as middleware or intermediary (connecting your systems to third-party AI providers or data sources), we process data in transit as necessary to facilitate the connection. We do not claim ownership of data passing through our systems and handle it in accordance with our Privacy Policy.

6. APIs and Rate Limits

  • API access is subject to rate limits and usage quotas as specified in the applicable documentation or service agreement.
  • We may modify, deprecate, or discontinue APIs with reasonable notice.
  • You must not share API keys or credentials with unauthorized parties.
  • Excessive or abusive API usage may result in throttling, suspension, or termination of access.

7. Third-Party Services

Our Services may integrate with, connect to, or rely on third-party services (including AI model providers, cloud infrastructure, data sources, and external APIs). We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services through our platform may be subject to their terms and conditions.

8. Intellectual Property

  • All rights, title, and interest in the Services (excluding Customer Data) remain with us.
  • Our trademarks, logos, and brand elements may not be used without prior written consent.
  • Open-source components are governed by their respective licenses.
  • Feedback or suggestions you provide may be used by us without obligation to you.

9. Payment and Billing

Certain Services may require payment. Fees, billing cycles, and payment terms will be specified in the applicable service agreement or pricing page. All fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with 30 days' notice.

10. Service Availability and SLA

We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance, updates, and unforeseen incidents may cause temporary disruptions. Specific uptime commitments, if any, will be outlined in separate service level agreements.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Services.

Our total aggregate liability for any claims arising from or related to the Services shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that AI-generated outputs will be accurate, error-free, or suitable for any specific purpose. You assume all risk associated with the use of AI outputs in your applications and workflows.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

14. Termination

  • You may stop using the Services at any time.
  • We may suspend or terminate your access if you violate these Terms or for any reason with reasonable notice.
  • Upon termination, your right to access the Services ceases. Provisions that by their nature should survive termination will remain in effect.
  • We may retain anonymized and aggregated data derived from your use of the Services.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by posting the revised Terms on this page and updating the "Last updated" date. Continued use of the Services after changes constitutes acceptance. If you disagree with updated Terms, you must stop using the Services.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Services shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or the courts of competent jurisdiction.
